By accessing or using Broken Window ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Broken Window is a professional intelligence platform that indexes publicly available professional data, hosts employer-submitted references, and provides Clout Scores for professionals. The Service is intended for employers, hiring managers, and professionals conducting legitimate professional due diligence.

3. User Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your account credentials. You may not share your account with others.

4. Submitted Content

By submitting a reference or any content to the Service, you represent that:

• The content is truthful and based on your direct professional experience
• You have the right to submit the content
• The content does not violate any applicable laws
• You are not submitting content to harass, defame, or harm any individual

Broken Window reserves the right to remove any content that violates these terms or that we determine, in our sole discretion, is inappropriate.

5. Clout Scores

Clout Scores are generated by AI research based on publicly available information. They are provided for informational purposes only and do not constitute an endorsement, recommendation, or professional assessment of any individual. Scores may be inaccurate and should not be relied upon as the sole basis for any hiring or business decision.

6. Prohibited Uses

You may not use the Service to:

• Submit false, misleading, or defamatory content about any individual
• Harass, stalk, or threaten any person
• Scrape or extract data from the Service without authorisation
• Use the API in violation of the API Terms
• Violate any applicable laws or regulations

7. Subscriptions and Payments

Paid subscriptions are billed in advance on a monthly or annual basis. Subscriptions automatically renew unless cancelled before the renewal date. Refunds are not provided for partial billing periods.

8. API Access

Use of the Broken Window API is subject to rate limits and fair use policies. API keys must not be shared or resold. Broken Window reserves the right to revoke API access for misuse.

9. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. Broken Window does not warrant that the Service will be uninterrupted, error-free, or that any information on the platform is accurate or complete.

10. Limitation of Liability

To the maximum extent permitted by law, Broken Window LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

11. Privacy

Your use of the Service is also governed by our Privacy Policy.

12. Profile Removal Requests

Individuals may request removal of their profile by contacting us at support@brokenwindow.ai. We will process legitimate removal requests within 30 days.

13. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms.

14. Governing Law

These terms are governed by the laws of the State of Delaware, USA.
